1. Eligibility & Account Responsibility
You must be at least 18 years old and legally capable of entering into binding agreements to use Forever CRM. You are responsible for

  • Maintaining the confidentiality of your login credentials
  • All activities occurring under your account
  • Ensuring your use complies with all applicable laws and regulations

ForeverCRM is not liable for unauthorized access caused by your failure to secure your account.

2. Scope of Service

Forever CRM provides an all-in-one customer relationship management (CRM) platform that may include, but is not limited to:

  • Contact and lead management
  • Messaging and communication tools
  • Funnel, pipeline, and workflow tools
  • Custom automations and system logic
  • Reporting and analytics

We reserve the right to modify, improve, or discontinue any feature at any time without liability.

3. Forever CRM Ownership & Intellectual Property
3.1 Platform Ownership

Forever CRM owns all rights, title, and interest in:

  • The Forever CRM platform
  • Software, source code, system architecture
  • Templates, workflows, automation logic, and system strategies
  • Branding, trademarks, and proprietary processes

Nothing in these Terms grants you ownership of any Forever CRM intellectual property.

4. Automations & System Logic (Critical Clause)
4.1 Automation Ownership

All automations, workflows, triggers, system logic, and strategies within Forever CRM are:

  • Locked
  • Non-transferable
  • Exclusively owned by Forever CRM

Automations are custom-built system assets developed from proprietary strategies and operational frameworks.
 They are not owned by users, even if configured for or used within a specific account.

4.2 Restrictions

You may not:

  • Copy, replicate, reverse-engineer, or export automations
  • Claim ownership over workflows or logic
  • Recreate Forever CRM strategies on competing platforms

Any attempt to do so may result in immediate termination and legal action.

5. ForeverCRM Transfers (No Transfers Allowed)
5.1 No CRM Transfers

Forever CRM does not allow CRM transfers under any circumstances.

This includes, but is not limited to:

  • Transferring accounts to another CRM platform
  • Migrating Forever CRM system structure, automations, or workflows
  • Reselling, sublicensing, or re-assigning access

ForeverCRM accounts are non-transferable by design.

5.2 Account Closure

Forever CRM reserves the right to:

  • Close, suspend, or terminate accounts due to violations, non-payment, or misuse according to Forever CRM’s policies and experiences with a customer account and commucation

Account closure does not grant any rights to platform assets or automations.

6. Data Ownership & Export
6.1 User Data

You retain ownership of your personal CRM data, including:

  • Contacts
  • Leads
  • Messages
  • Notes
  • Custom fields entered by you
6.2 Data Export

Forever CRM allows users to export their personal data directly from the CRM interface, subject to system limitations.

However:

  • System logic, automations, workflows, and platform structures cannot be exported
  • Exporting data does not include Forever CRM intellectual property

You are responsible for exporting your data before account termination or closure.

7. Prohibited Uses

You agree not to:

  • Use Forever CRM for unlawful, abusive, or fraudulent activities
  • Attempt to bypass system restrictions
  • Resell or white-label Forever CRM without authorization
  • Scrape, copy, or reverse-engineer the platform
  • Compete unfairly using Forever CRM intellectual property

Violation may result in immediate termination without refund.

8. Payments, Billing & Refunds

All fees are:

  • Charged in advance unless stated otherwise
  • Non-refundable unless explicitly agreed in writing

Failure to pay may result in suspension or termination.

Forever CRM may change pricing with reasonable notice.

9. Service Availability & Disclaimers

Forever CRM is provided “as is” and “as available.”

We do not guarantee:

  • Uninterrupted service
  • Error-free operation
  • Specific business results

Use of Forever CRM is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, ForeverCRM shall not be liable for:

  • Lost profits
  • Lost data
  • Business interruption
  • Indirect or consequential damages

Our total liability shall not exceed the amount paid by you in the last 30 days.

11. Termination

Forever CRM may terminate or suspend access:

  • With or without notice
  • For violations of these Terms
  • For misuse or abuse of the platform

Upon termination:

  • Access is revoked
  • Automations remain Forever CRM property
  • Transfers remain prohibited
12. Governing Law

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located within the State of New Jersey, and the parties hereby consent to the personal jurisdiction and venue of such courts.

13. Changes to Terms

We may update these Terms at any time. Continued use of Forever CRM constitutes acceptance of the revised Terms.
